If you do not provide this data, we may not be able to create your account or to provide the requested Application or function.
We may obtain data about you from publicly and commercially available sources as permitted by law or collect data about you through third-party services as well. This may include:
- Account information provided by your company’s admin user when creating a sub-account for you.
- Synchronization of existing company or project information from CRM or similar systems.
- Marketing materials that you have previously authorized PERI to use for advertising purposes.
3. Purposes and Usage of the Data Processing
We process your personal data only where we have a legal basis for doing so. The purposes below are grouped according to the basis on which we rely. Unless otherwise stated in this Notice, if you object to or restrict the collection and processing of your personal data for these services, you may no longer be able to use the relevant service(s) or parts thereof.
3.1 Processing to provide the Applications under the Terms of Use
In order to provide the services you request in the Applications, and to perform our contract with you under the Terms of Use, we process personal data for the following purposes:
- We process your account and company information to register user accounts and to grant access to the Applications, including their functions and features, for you and your colleagues.
- We process your account and company information to help you manage your projects with PERI through the Applications. This includes, but is not limited to, checking your project status, tracking materials, processing your orders, accessing project documents, sending in-App notifications, receiving updates and learning more about PERI products and services.
- We process your account and company information, together with the content of your message, in order to answer your enquiries and to provide you with support when you contact us through a contact form in an Application, through the support addresses stated in the Terms of Use, or by email.
- Where you use an Application against payment, we process your account and company information to invoice and administer the agreed fees.
- We process your IT data and store it in log files to ensure the functionality and stability of the Applications you use and to facilitate the communication of information between backend servers and the Applications.
3.2 Processing on the basis of our legitimate interests
We also process personal data where this is necessary for the legitimate interests we pursue in operating and safeguarding the Applications. On this basis, we process personal data for the following purposes:
- We process your account and company information, using pseudonymized or anonymized forms wherever possible, to improve our service quality for you and your company. This includes aligning project status with our colleagues supporting your projects and using this information for internal reporting purposes.
- We process your IT data in log files to maintain the security of our systems, to keep the security audit trails we are required to keep, to detect and investigate misuse of the Applications, and to conduct first-party usage analysis for debugging and feature enhancements.
- We may post marketing materials that could contain personal data but do not target specific individuals, such as photos from construction sites or videos filmed at PERI events, within the Applications for our users.
3.3 Processing on the basis of your consent
On the basis of your consent, we process the following personal data for the associated purposes. You can revoke your consent at any time with effect for the future. The lawfulness of data processing prior to your withdrawal remains unchanged.
- We may post marketing materials that could contain personal data within the Applications for our users. This usage is authorized through your signed consent declaration form or similar authorization document. You can revoke your consent or authorization at any time by contacting the PERI contact you worked with.
- With your consent, we will send you direct marketing communications via in-App notifications and/or email, depending on your selection. You can withdraw your consent at any time by turning off this function in your account settings.
3.4 Processing to comply with legal obligations and to protect our rights
In addition, we may process your personal data to the extent necessary to comply with legal obligations, including tax and accounting requirements, and to assert or defend our legal rights and/or to prevent, detect and pursue potential fraud or cyber-attacks.
4. Cookies and Similar Technologies
In our Applications, we use ‘cookies’ — a term that encompasses not only traditional small text files stored on your device but also other similar technologies, including pixel technology and log file analysis.
For the majority of the Applications, we use essential cookies only. Essential cookies are necessary for the technical operation of an Application. They allow the Application to be delivered to your device, keep your session active and remember basic settings such as language or font size, so that you do not have to configure your preferences each time you use the Application. Without these cookies, an Application would treat you as a new visitor with every page you load. We process the personal data obtained through essential cookies exclusively in order to provide you with a fully functional and secure service.
Where an Application also uses functional cookies (for example, to integrate mapping and streaming services or to compile third-party usage statistics) or marketing cookies (for example, to tailor advertising to your interests), we set these cookies only with your consent. You can find further information on the individual cookies used, and you can give, change or withdraw your consent at any time in the preference center or account settings within the relevant Application.
You can also prevent or delete the storage of cookies through your browser settings. Please be aware that doing so may impact the functionality of the Applications, because essential cookies are crucial for their technical operation.
5. Data Sharing and Transfers
- Location of data storage: Your personal data will be securely stored in the EU. We ensure that adequate protection measures are in place, in accordance with applicable data protection laws, to safeguard your personal data.
- Disclosure to service providers: We work with internal and external service providers, including project management providers, IT support providers, customer service agencies, warehousing service providers, marketing agencies and repair companies, to provide you with trouble-free services. They only have access to your personal data to the extent that this is necessary to fulfill their contractual obligations to us. Our service providers have been carefully selected and commissioned by us and are contractually bound. They will not process your personal data for any other purposes.
- Sharing within the PERI Group: Where this is necessary for the purposes described in this Notice, we share your account and company information with other companies of the PERI Group, for example, so that the PERI company supporting your projects can assist you, to provide customer service, and for the group-wide administration of customer and prospect data. Some PERI Group companies are located outside the European Economic Area; in those cases the safeguards described under ‘Cross-border transfer’ below apply.
- Legal or regulatory disclosures: PERI may disclose your personal data to comply with the requirements of applicable laws and regulations, to respond to requests from regulatory authorities, courts or government agencies, or to assert or defend our legal rights.
- Cross-border transfer: Your personal data may be transferred outside the European Economic Area. Such transfers will only occur when necessary for performing the Terms of Use, when legally mandated, when you have provided explicit consent, or as part of a data processing/sharing agreement. We have implemented appropriate safeguards for these transfers, which include the execution of data processing/sharing agreements based on the standard contractual clauses or equivalent measures recognized or mandated by the respective jurisdiction, to ensure an adequate level of data protection.
6. Data Security
Our employees and the companies providing services on our behalf are obliged to maintain confidentiality and to comply with the applicable data protection laws. We take all necessary technical and organizational measures to ensure an appropriate level of security and to protect your data that are administered by us, especially from the risks of unintended or unlawful destruction, manipulation, loss, change, or unauthorized disclosure or unauthorized access. Our security measures are, pursuant to technological progress, constantly being improved.
7. Data Retention and Disposal
We will not retain your personal data for longer than is necessary to provide our goods and services, fulfill the purposes set out in this Privacy Notice, and comply with legal obligations. Our retention periods are regularly reviewed to ensure ongoing compliance and relevance and follow the principles set out below:
- Account and company information: We delete your account and company information when you delete your account or when your user relationship under the Terms of Use ends. Deleted data is first moved to a trash bin so that an accidental deletion can be reversed, and is permanently deleted once the defined grace period has expired. Where we need to retain the data for longer — for example to meet accounting or taxation obligations, or to deal with an open customer support matter — we retain it for that purpose only and delete it once the relevant period has expired.
- IT data: We retain your IT data in log files in line with the requirements that apply to our security audit trails, and delete or anonymize it once those requirements no longer apply.
- Marketing materials: We retain the marketing materials until the post is actively rotated, until the expiration date of your consent/authorization, or until you withdraw your consent/authorization, whichever comes first.
